The North Carolina Bar Association released the Second Edition of Common Interest Communities in North Carolina on Friday February 15, 2019. The book follows on the First Edition which was published in 2013 by Brian S. Edlin.
In the 6 years since the First Edition of Common Interest Communities was published, there have been a number of changes in the law affecting planned communities and condominiums. The Second Edition updates the law in several key areas and adds a number of new cases and statutes, both federal and state.
Additionally, the local ordinances for the largest counties and municipalities have been updated and revised. The Second Edition is packed and updated with more than four (4) dozen new North Carolina appellate cases since and nearly three (3) dozen new out-of-state cases on various association operations. All cases have now been organized by topic and indexed dealing with a complete range of association issues and there are new sections on encroachment agreements; easements; land condominiums; subdivision performance bonds; house boat communities; and architectural control committee bonds. Additional treatment of the allocation of deductible; liability issues related to landscaping and sports teams; fair housing; wild animals; rivers and streams; set-backs and golf courses is also contained in the book.
