Senate Bill 228 (Session Law 2013-34) was signed into law by the Governor on 24 April 2013. Among other things, the legislation requires that courts enforce the bylaws, articles of incorporation and declaration for planned communities by their terms. In addition, the new law expressly provides that any amendment passed pursuant to the Planned Community Act or the procedures in a declaration are presumed valid and enforceable.
